Terms of Service

Effective date: July 30, 2026

These Terms of Service ("Terms") govern access to and use of the SiteHawk industrial monitoring platform, including our websites, web application, and mobile applications (the "Service"), provided by Heart of Oaks Automation ("we," "us," or "our").

By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.

1. The Service

SiteHawk provides tools for industrial and multi-site operations, which may include telemetry monitoring, alarm management, notifications, dashboards, process views, mobile access, and AI-assisted investigation features. Features available to you depend on your organization’s configuration, subscription, and role-based permissions.

2. Accounts and access

  • You must provide accurate account information and keep credentials secure.
  • Access is typically provisioned through your organization and authenticated via our identity provider.
  • You are responsible for activity that occurs under your account.
  • Organization administrators are responsible for managing users, roles, and access within their tenant.

3. Acceptable use

You agree not to:

  • Use the Service in violation of applicable law or regulation.
  • Attempt to access data or tenants you are not authorized to access.
  • Interfere with or disrupt the Service, including probing, scanning, or overloading systems except as expressly permitted for authorized security testing.
  • Reverse engineer, resell, or misuse the Service except to the extent such restriction is prohibited by law.
  • Upload or transmit malicious code, or use the Service to send unlawful or abusive communications.
  • Use AI assistant features to attempt to bypass access controls or extract data outside your authorized scope.

4. Customer data and industrial operations

Your organization retains ownership of the operational and configuration data it submits to the Service ("Customer Data"). You grant us a limited license to host, process, transmit, and display Customer Data solely to provide and improve the Service.

SiteHawk is a monitoring and operations support tool. It is not a safety instrumented system, emergency shutdown system, or substitute for qualified on-site judgment, independent safety controls, or regulatory compliance programs. You are solely responsible for how your organization uses the Service in connection with industrial processes, alarms, and operational decisions.

5. AI-assisted features

Some features use third-party AI model providers to process prompts and related context. AI outputs may be incomplete, incorrect, or outdated. You should verify critical operational information through primary systems and qualified personnel before acting.

6. Notifications

Alarm and operational notifications (email, SMS, and/or mobile push) depend on correct configuration, third-party delivery networks, device settings, and network availability. We do not guarantee that every notification will be delivered, timely, or read.

7. Intellectual property

We and our licensors own the Service, including software, branding, and documentation. These Terms do not grant you any rights to our trademarks or other intellectual property except the limited right to use the Service as permitted herein.

8. Third-party services

The Service may rely on third-party services such as authentication, hosting, messaging, push notifications, and AI providers. Your use of those services may also be subject to their terms and privacy policies.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT DATA WILL ALWAYS BE ACCURATE OR COMPLETE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEART OF OAKS AUTOMATION AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED U.S. DOLLARS (US $100) IF YOU HAVE NOT PAID ANY AMOUNTS.

11. Indemnification

You will defend and indemnify Heart of Oaks Automation against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your Customer Data, your use of the Service, or your violation of these Terms or applicable law.

12. Suspension and termination

We may suspend or terminate access to the Service if you violate these Terms, if required for security or legal reasons, or if your organization’s access ends. Upon termination, your right to use the Service stops. Provisions that by their nature should survive will survive termination.

13. Privacy

Our collection and use of personal information is described in our Privacy Policy.

14. Changes

We may update these Terms from time to time by posting a revised version on this page and updating the effective date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
